QDROs: Effective Drafting
Author: Timothy C. Voit

Description:
Growing in importance is the division of retirement benefits by way of a qualified domestic relations order (QDRO). A thoroughly designed QDRO not only divides retirement plan assets when the retirement plan is viewed as a marital asset--which is the most common use--but also secures the former spouse?s share in case of unforeseen but possibly devastating events.

This course examines, in detail, the plan administrator's responsibilities, the QDRO process, as well as the various benefit division methods necessary to draft a QDRO. It alerts practitioners to the pitfalls of such contingencies and arms professionals to create solid plans. Topics covered include:

  • Types of QDROs
  • Benefit and Payment Options Under a Defined Benefit Plan
  • Preparing the Initial Draft QDRO
  • Methods of Dividing Retirement Benefits and Retirement Accounts
  • Additional Considerations and Sample Language
  • Concluding the QDRO Process
  • Potential Problems and Issues--Emphasis on Avoiding Malpractice
  • Responsibilities of the Plan Administrator, the Court, and the Attorneys
